Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Big Bear Pros (the “Service”), a product of SAUERAPPLE LLC, a California limited liability company. Big Bear Pros is a directory that helps local professionals (“Pros”) publish a public page and helps people looking for help (“Seekers”) find and contact them in Big Bear Valley and nearby mountain communities. In these Terms, “we,” “us,” and “our” refer to SAUERAPPLE LLC.

By creating an account, publishing a listing, messaging through the Service, or otherwise using Big Bear Pros, you agree to these Terms. If you do not agree, do not use the Service.

Also read our Privacy Policy, which explains how we handle personal information. By using the Service, you consent to receive electronic communications from us related to your account and the Service (including transactional notices and, for Pros, product emails described in the Privacy Policy).

Big Bear Pros is a platform and directory. We are not a party to any job, booking, sale, lesson, performance, or other arrangement between Pros and Seekers. We do not employ Pros, guarantee their work, verify licenses or insurance (except collecting self-attestation where noted), or set prices for their offerings. Pros are independent providers; nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between us and any Pro or Seeker.

Any agreement for services or products is solely between the Pro and the Seeker. You are responsible for evaluating fitness, credentials, insurance, and safety before hiring or being hired.

You must provide accurate account information and keep it updated. You are responsible for activity under your account and for keeping your password confidential. Notify us promptly if you suspect unauthorized access.

You must be at least 18 years old (or the age of majority where you live) to create an account or publish a Pro listing. Parents or guardians are responsible for any use by minors who browse public pages.

We may require email verification before certain features (such as starting a message thread) work. One person or entity should not create multiple accounts to evade suspension, billing, or rate limits.

If you publish a Pro page, you represent that information you provide (name, bio, photos, offerings, prices, contact details, categories, areas, and related content) is accurate and that you have the right to post it.

You retain ownership of content you submit. You grant SAUERAPPLE LLC a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt for formatting, and distribute that content as needed to operate, promote, index, and improve the Service (including showing your listing in browse results, category/area pages, sitemaps, share links, caches, and search-engine structured data). This license continues for a reasonable period after you unpublish or delete content so that copies in backups, caches, and third-party indexes can expire naturally.

For categories that require attestation, you confirm any statements you check at publish time. Listings are self-reported. Seekers should always verify licensing and insurance for regulated work. Public pages may display a disclaimer to that effect.

We may remove, suspend, refuse, or pause listings that violate these Terms, appear fraudulent or unsafe, harm the community, or are associated with unpaid or lapsed subscriptions—without obligation to monitor all content in advance.

Pros may publish with a limited free trial window (currently 30 days from first publish, as shown in the product). After the trial, keeping a page live generally requires a paid subscription (currently $20/month, billed through Stripe). Prices and trial terms may change; we will describe current pricing in the product before you subscribe.

Payment processing is handled by Stripe. By subscribing, you also agree to Stripe’s terms for payment. Fees are typically non-refundable except where required by law or where we expressly offer a refund. To cancel a paid subscription, contact us at hello@bigbearpros.com; we may also provide Stripe-hosted billing tools in the product. Unless we say otherwise, access continues through the end of the paid period after cancellation.

If payment fails or a subscription lapses, we may pause or unpublish your listing until billing is resolved. Messaging and other features may be limited while a listing is paused.

Taxes may apply based on your location and payment processor rules. You are responsible for any taxes associated with your use of paid features, except taxes based on our net income.

The Service may let Seekers and Pros message each other, share public contact details you choose to display, and collect reviews. Do not use messaging for spam, harassment, scams, or illegal activity. Do not post others’ personal information without permission.

We may email account holders when they receive a new message. Reviews must reflect genuine experiences. We may hide or remove reviews that appear fake, abusive, or unrelated to the listing. Review invites and rate limits may apply as described in the product.

You agree not to:

• Break any law or infringe others’ rights
• Post false, misleading, defamatory, or infringing content—including fake credentials or impersonation
• Scrape, harvest, or bulk-export listings or user data without our written permission
• Interfere with the Service, probe for vulnerabilities beyond authorized security research we invite, or circumvent access controls
• Use the Service to send unsolicited commercial messages unrelated to a bona fide inquiry about a listing
• Upload malware or content that is exploitative, especially involving minors
• Reverse engineer the Service except to the extent such restriction is prohibited by law
• Use the Service to build a competing directory by systematically copying listings or user content

We may modify, suspend, or discontinue features of the Service at any time. We aim for reliable availability but do not guarantee uninterrupted or error-free operation. Scheduled or emergency maintenance, third-party outages, and force majeure events may affect access.

The Big Bear Pros name, branding, site design, and software are owned by SAUERAPPLE LLC or its licensors. You may not copy or reuse them except as needed to use the Service as intended.

If you send feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.

If you believe content on the Service infringes your copyright, send a notice to hello@bigbearpros.com with: (a) your contact information; (b) a description of the work claimed to be infringed; (c) the URL or location of the allegedly infringing material; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement under penalty of perjury that the information in the notice is accurate and that you are the owner or authorized to act; and (f) your physical or electronic signature. We may remove or disable access to material and, in appropriate circumstances, terminate repeat infringers.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, THAT PROS ARE LICENSED OR INSURED, OR THAT ANY TRANSACTION BETWEEN USERS WILL MEET YOUR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, SAUERAPPLE LLC AND ITS AFFILIATES, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY DEALINGS BETWEEN USERS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

You agree to defend and indemnify SAUERAPPLE LLC and its affiliates, officers, and agents against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, your interactions with other users, or your violation of these Terms.

You may stop using the Service at any time. To delete your account or personal data, contact us as described in the Privacy Policy. We may suspend or terminate access, or remove content, if we believe you violated these Terms or if needed to protect users or the Service. Provisions that by nature should survive (including licenses needed for residual copies, disclaimers, indemnity, and liability limits) will survive termination.

The Service may integrate or link to third parties (including Stripe Checkout, auth providers, and external websites Pros list). We are not responsible for third-party services, and your use of them may be subject to their terms.

We may update these Terms from time to time. We will post the updated version with a new effective date. For material changes, we may also provide additional notice. Continued use after changes become effective constitutes acceptance. If you disagree, stop using the Service and cancel any subscription.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts located in California will have exclusive jurisdiction, except where applicable law gives you mandatory rights to bring claims elsewhere.

These Terms, together with the Privacy Policy and any in-product pricing or attestation statements you accept, are the entire agreement between you and us regarding the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
